1. Reservations and Retainer Fee

To secure a session date, a non-refundable retainer fee corresponding to the selected package is required. Reservations are confirmed only upon receipt of payment confirmation.

The retainer fee covers the reservation of the date and time, scheduling logistics, operational preparation, and the temporary unavailability of that time slot for other clients.

2. Rescheduling and Force Majeure

Sessions may be rescheduled without penalty in documented cases of force majeure, including but not limited to:

accidents,
illness,
severe weather conditions,
flight cancellations,
or major travel disruptions beyond the client’s control.

Rescheduling requests are subject to calendar availability.

Requests to reschedule within less than 48 hours prior to the session date, as well as no-shows, will result in forfeiture of the initial retainer fee and may require an additional rescheduling fee equivalent to 20% of the original retainer amount.

3. Session Experience and Client Cooperation

To ensure the best possible experience and maintain the creative flow of the session, clients and guests are kindly asked to avoid taking cellphone photos or videos during the shoot. This allows the photographer to maintain consistency in lighting, posing, composition, and artistic direction throughout the session.

Clients acknowledge that the final quality and outcome of the session may be affected by factors outside the photographer’s control, including but not limited to:

weather conditions,
lighting conditions,
participant cooperation,
venue restrictions,
delays,
or failure to follow preparation recommendations.

4. Punctuality

Clients are expected to arrive on time for their scheduled session.

Late arrival will reduce the effective shooting time of the session, as sessions are planned according to lighting conditions, sunset schedules, and operational timelines.

Clients are kindly asked not to arrive significantly earlier or later than the scheduled time, as the photographer may be attending another session before or after the reservation.

5. Preparation and Repeat Sessions

Clients are responsible for arriving prepared for the session, including wardrobe selection, hair styling, makeup, and overall appearance.

If the client wishes to repeat the session due to personal aesthetic preferences or preparation issues unrelated to the photographer’s performance, the new session will be treated as an entirely separate booking and charged accordingly.

6. Image Selection

Depending on the selected package, image selection may take place through an online gallery or in person.

Once the client confirms the final image selection, no further substitutions or changes will be permitted.

If the selection is not completed within the designated timeframe, the gallery may be temporarily deactivated. Gallery reactivation will incur a $10 USD fee.

7. Payments and Additional Orders

All services, products, upgrades, and additional image orders must be paid in full at the time of purchase.

Final galleries, digital files, prints, or other deliverables will only be released once all outstanding balances have been fully paid.

8. Editing and Artistic Style

The standard editing process includes:

color correction,
exposure and contrast adjustments,
density calibration,
and basic skin retouching.

Additional aesthetic modifications or advanced retouching requests may incur extra charges depending on the complexity and editing time required.

Clients acknowledge and appreciate the photographer’s artistic style, editing approach, and creative direction as reflected in Ohana Photo Shop’s portfolio and previous work. By booking a session, clients accept the photographer’s creative and aesthetic judgment.

Clients are respectfully asked not to apply external filters or heavy modifications that substantially alter the artistic integrity of the delivered images.

9. Delivery and Backup Policy

Final edited galleries are typically delivered within approximately 2 business days in high-resolution digital format. The number of delivered images depends on the selected package.

Ohana Photo Shop currently provides unlimited cloud backup storage for delivered galleries while company services remain active. However, clients are strongly encouraged to maintain personal backups of all files in multiple locations and personal cloud services.

In the event that a gallery requires reopening after archival or deactivation, a reopening fee of $15 USD may apply, and the gallery will remain available for download for 15 days.

10. Personal Use License

For family sessions, couples sessions, pet photography, graduations, and social events, delivered images are licensed for personal use only.

Clients may:

share images on social media,
make personal prints,
and store the digital files for personal purposes.

Commercial use, resale, publication, advertising, or business-related usage is strictly prohibited without written authorization from Ohana Professional Photography of Costa Rica S.A.

11. Commercial Use and Licensing

Commercial photography projects are subject to separate licensing agreements specifying:

authorized usage,
duration,
distribution rights,
and geographic territories.

Any unauthorized commercial use or breach of licensing terms may result in legal action to protect the company’s intellectual property rights.

12. Copyright Ownership

Ohana Professional Photography of Costa Rica S.A. retains full copyright ownership of all photographs and visual content created during its sessions.

Clients receive a personal usage license for the delivered images according to the terms established in this agreement.

Copyright ownership is non-transferable unless explicitly stated otherwise in a written agreement signed by both parties.

13. Final Acceptance

By booking a session and submitting payment, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.

14. Outstanding Balances

All deliverables are released only after full payment of any outstanding balances related to the session, products, upgrades, or additional services.
